  • The FTC warned that businesses which set prices using shoppers' personal data without telling them could be breaking the law, publishing an enforcement bulletin on the practice Wednesday and asking for public comment.
  • Chairman Andrew Ferguson said the agency cannot ban personalized pricing outright, but retailers who imply a listed price is static when it actually changes per shopper may be violating the FTC Act against deceptive practices.

  • Published August 18, 2026, the voluntary framework applies one test: whether the AI use creates a material risk of misleading a reasonable consumer about what is authentic, factual, or human-created, rather than counting how many AI tools sit in the production chain.
